uKid Service is a communication and location service and device (the device hereinafter referred to as "uKid Device", together with the service — "uKid Service"), which enables monitoring and tracking of the movement of a person using uKid service and learning the location thereof, as well as call and (or) send short message (SMS) to preliminarily selected 5 (five) trusted people and (or) warn them of the fact that a person using uKid Service is in a danger. You can use uKid Service through uKid Application.
Your access to and use of uKid Service must comply with (1) these Terms; (2) contracts concluded between you and the third party, i.e. your communication service provider — Ucom CJSC(hereinafter referred to as "Ucom" or “we”), application store/platform or device provider, and (3) all applicable laws, rules and regulations. You must be at least 18 years old in order to subscribe to uKid Service.
By accessing or using any function of uKid Service, you acknowledge that you fully accept these Terms. If you do not agree with these Terms, you may not use any of uKid Service functions.
Overview: The mobile application ("uKid Application") is provided and delivered by SMARTCOM Inc. company (hereinafter referred to as "Smartcom") ("uKid" powered by SMARTCOM). uKid Device can be configured, monitored and contacted through uKid Application. You may not transfer your right to use or access uKid Service to any third party. You may not use uKid Service for commercial purposes without the prior written consent of Ucom.
uKid Device will operate with its intended purpose only if you have concluded a service contract with Ucom. The specified contract is concluded between you and Ucom. Smartcom is not a party to the specified contract and does not exercise supervision over Ucom's actions. At the same time, you acknowledge that uKid Application is provided by the Smartcom, and Ucom provides uKid Application on "as is" basis.
Location Device / Emergency: uKid Service is to be used as a location device. However, uKid Service is not a failsafe security system.
Incompatibility with "911" system: uKid Device is not compatible with emergency calls response "911" or other similar systems. Thus, emergency calls from uKid Device will be forwarded to the predefined recipient instead of the emergency services personnel. uKid Device is not designed to be compatible with telecommunications accessibility features or services (i.e. TTY, audio prompts or other similar services).
Privacy: uKid Device is constantly collecting and transmitting data such as location data to uKid. Such detailed data collection and use is of essential importance for the successful provision of uKid Service.
Who is our customer? Our customer is a natural person who has subscribed to uKid Service. We are under no obligation to respond to requests, inquires, demands or communications from any party (such as another family member) other than our customer.
uKid Application license: In order to use uKid Service you will need to download and install uKid Application. uKid hereby grants you a non-exclusive, non-transferable, revocable, limited license to use uKid Application solely on devices that you own or manage. You represent and warrant that you have the right to install and use uKid Application on the devices you are using. You are not entitled to remove, obscure, modify or disable proprietary notices from SMARTCOM on any part of uKid Service. You may not transfer this license to another party unless that party accepts these Terms of Service. You may not use uKid Service for any purpose that is illegal or potentially harmful to another party.
Uninstalling of uKid Application: You may uninstall uKid Application at any time by deleting it from your device in the same manner that you delete similar applications.
uKid Application Updates: uKid may change, update or otherwise modify uKid Application or the software on uKid Device at any time. In such cases you have to download the changed/modified or new version of uKid Application or software in order to continue using uKid Service. You also agree that we may automatically install updates to uKid Application or uKid Device without additionally notifying you thereon.
Termination of access: In addition to other rights or remedies that may be available to us under this uKid Service Terms and the applicable law, we may at any time, with or without notification, fully or partially suspend, restrict or terminate your Ucom Application account or your access to uKid Service where (1) you have breached these Terms; (2) such action is necessary to prevent harm to any party or incurrence of liability to Smartcom; or (3) Ucom is no longer providing services for your Device.
Disclaimer of Additional Warranties: except for warranty provided for device, we do not make any representations or provide any established or implied warranties of any kind, including, without limitation, warranties on non-infringement, title, merchantability or fitness for a particular purpose. We do not warrant that uKid Service functions or any material or content contained therein will be completely secure, uninterrupted or error free, that defects will be corrected, or that the server that makes the service free-of-charge will be free of viruses or other harmful components. We shall not be liable for the use of uKid Service, including, without limitation, the content and any errors contained therein provided by third parties. In no event shall we bear delictual, contractual, strict liabilities or other liabilities implied by legal or equitable norms for any direct, indirect, special, incidental, or other consequential damages, lost profits, lost data, lost opportunities, costs of cover, exemplary, punitive, bodily injuries/wrongful death, each of which is hereby excluded by agreement of the parties regardless of whether or not we have been informed of the possibility of such damages. In addition, uKid Service terms may be changed at any time without prior notice. We will make such changes by posting them on Ucom's website at www.ucom.am or by notifying you of such changes. You are responsible for regularly checking the availability of those changes. Your continued access to uKid Application conclusively demonstrates your acceptance of those changes.
Severability: If, for any reason, any part of these Terms is held or declared invalid or unenforceable by any court of competent jurisdiction, those provisions shall be ineffective, but shall not affect any other part of these Terms of Service.
uKid Device complies with FCC RF (RoHS, CE) radiation exposure limits set forth for an uncontrolled environment. For body-worn operation and use near the head, uKid Device has been tested and recognised as complying with the FCC RF exposure guidelines when used with the wrist strap supplied with this device. Use of other accessories may not ensure compliance with FCC RF exposure guidelines.
Third parties: Ucom, Apple®, Google® and other third party carriers, platform or software providers and device manufacturers ("Platform Providers") are not third parties to these Terms of Service. Except as otherwise agreed in writing between you and the respective Platform Provider, Platform Providers have no obligation to furnish any maintenance and support services with respect to uKid Service.

PRIVACY POLICY
Overview
Personal information collected through uKid Application: Through uKid Application we may collect information on your name, email address, date of birth and other personal information, as well as that of the person who is going to use uKid Device. We do not collect personal information from you unless you voluntarily provide it to us.
Location-based information collected through uKid Service: UKid Device automatically and constantly collects information about the actual location of uKid Device when it is in use. Information is acquired through numerous methods, including Global Positioning System (GPS), cell towers and WiFi hot spots, which are enhanced over time as we develop uKid Device, collect more information and improve our tracking. You may not disable location-based information collection in uKid Device. We may also collect such location-based information through your use of uKid Application.
Information usage and third party sharing: Personal information and location-based information is treated as sensitive information by Ucom and is subject to a heightened standard for sharing, as opposed to non-personal or de-identified information which may be shared with any number of parties. Therefore, we may use your information to: respond to your inquires or requests; send you information about uKid Service (such as promotions, maintenance or security information); send you a limited number of offers for additional products and services that may interest you, but we will not provide your personal information to third parties for them to contact you directly for their own benefit without your consent; permit our vendors and subcontractors to provide services, provided that they are under an obligation of confidentiality and do not use the information for their own benefit; comply with applicable law or legal process; provide to a third party for their own use, such as marketing, but only if you have given your consent to such third party sharing; investigate suspected fraud, harassment, danger to persons or property or other violations of any law, rule or regulation, or the terms or policies for uKid Service or our business partners; share with law enforcement and other parties trying to locate a lost child, including sharing the audio content of emergency calls; develop and enhance our own data, such as through tracking the location of your uKid Device, provided that any disclosure of such data does not specifically identify you, your uKid Device or your specific location; transfer information in connection with the sale or merger or change of control of uKid or the division responsible for the services with which your information is associated; share non-personal or de-identified information with any number of parties, including analytics companies, technology providers and other business partners; or combine it with data from other sources outside of your use of uKid Service, such as data obtained from WiFi access points within range of your uKid Device. You also accept that your information may be provided to state and local self-government bodies, courts in cases prescribed by the law and other legal acts.
Auto deletion of data: We may automatically delete data from uKid Device or from uKid Application in connection with a returned or terminated account or device, or, as necessary, to protect against unauthorized access to the data.
Security: The security of your information is very important to us. We use reasonable efforts at Ucom to protect it from unauthorized access. However, due to the inherent open nature of the Internet and wireless communications, we cannot guarantee that your personal information will be completely free from unauthorized access by third parties, e.g. when transferred over or through systems not within our exclusive control. Your use of our uKid Service demonstrates your assumption of this risk. We have established reasonable physical, electronic and managerial procedures to safeguard the information we collect. Only those employees who need access to your information in order to perform their duties are authorized to have access to your personal information.
You represent and warrant that you will use uKid Service only for your legitimate purposes, without violation of rights of third persons prescribed by the legislation of the Republic of Armenia.
Changes to the Privacy Policy: We reserve the right, at our discretion, to change, elaborate, add or remove provisions from this Privacy Policy at any time. However, if at any time in the future, we plan to use personal information or location-based information in a way that essentially differs from this Privacy Policy, such as sharing such information with other third parties; we will post such changes here and provide you with opportunity to opt-out of such differing use. Your continued use of uKid Service following the posting of any changes to this Privacy Policy means you accept such changes.
Opt-out process: You may opt-out of our marketing messages. Such requests should be sent to us at 444@ucom.am and we will consider your request within a reasonable time after receipt thereof. However, we are not responsible for removing your personal information from the lists of any third party who has previously been provided your information in accordance with this Privacy Policy or Your consent, such as a sponsor. You should contact such third parties directly. If you no longer want any data collected by uKid from your uKid Device, then you will need to deactivate the service.
United States of America: Our servers are maintained in the United States of America. By using uKid Service, you freely and specifically give us your consent to export your personal information to the USA and to store and use it in the USA as specified by this General Terms and Conditions. You accept that data stored in the USA may be subject to lawful requests by the courts or law enforcement authorities of the USA, and the latters may receive the information in accordance with legislation.
